My son, Joshua (19), was found dead in Amsler Park/McGregor, Texas, on February 16, 2006. Without an investigation or asking me, the mother, any questions, the police presumed his death to be from Suicide!
After the fog cleared, I began to contemplate about this supposed suicide, knowing that my son would not take his own life. Also knowing that I had to consider the possibility to remain objective.
I used the FOIA to obtain 'any and all documents' related to the death of Joshua Robinson. In the beginning, I only rec'd the statements of the former detective, Kory Martin, and former Sgt. Jeff Freeman and a partial listing of the dispatch logs, beginning with the dispatch to Amsler Park. Of course, not knowing PROPER police protocol, I once again filled out an FOIA form, requesting the statments of the on duty officers, crime scene photos, and the FULL dispatch logs! I specifically requested the official time of the 911 call made by the complainant, who will remain as Anonymous.
On April 24, 2006, I rec'd a call from the former City Secretary, advising me that the statements from the on duty officers had not yet been generated, meaning that they had not yet made or written their statements. On April 28, I rec'd another call from the city secretary, informing me that the requested documents were ready for me to pick up.
I analyzed the documents, noting the inconsistencies in the statements of the four officers. I noted that per the dispatch logs, the officers (2) were not BUSY as they depicted themselves to be, I also noted that the crime scene photos were not that of a suicide! However, I did notice that the time of the 911 call was not included in these documents. When I inquired about this, I was told that this document had been destroyed! WHY?????
I asked questions:
1) How and why run a wants and warrants check on an unknown subject with no identification?
2) How is it possible for former Officer Kirby to have been the first on the scene, as his patrol car (#1507) was not dispatched to Amsler Park?
3) Why was former Sgt. Freeman called on duty @ 4:37AM?
4) Why wasn't this death investigated as a homicide until proven otherwise?
I began my research by typing in the word 'hangings', and although computer illiterate (then), the whole world opened up to me.
I learned judicial/suspended hangings, suicide statistics, manner and cause of death, rigor and livor mortis, cadaveric spasm, ligature strangulation, mechanical asphyxia, positional asphyxia, overlay deaths, dry/wet/near-drownings, laryngospasm, digestion processes pertaining to time of death, etc.
Per the statements, 'the body was cold and stiff to the touch', telling me that rigor mortis had already taken place, which meant he had been dead for 3-4 hours by the time the officers arrived on scene, at 5:36AM!
Per a story in "The Waco Tribune Herald" on Friday, February 17, 2006, 'McGregor Man Found Dead in Park', the police were investigating.
So, I called former Interim Chief, Chris Molina, on Feb. 22, to inquire into the progress of the investigation. He told me, "We don't begin an investigation until something suspicious is found." I told him that the whole thing is suspicious because my son would not kill himself. He said, oddly, "At ten after one, there was nobody in the park." I once again analyzed the dispatch logs, noting that there was no indication of a 'park check' @ 1:10AM, nor was Molina on duty!
About two weeks later, I spoke with former Det. Kory Martin. He told me, "As of today, the investigation is over." I asked, What investigation, Molina told me there wasn't one." He told me he had conducted his own investigation by interviewing my son, Michael, Josh's girlfriend Kayla, and Mr. Bill Holt, who ran the perimeter of the park everyday.
I called Mr. Holt, and he told me that no officer had talked to him. I asked Michael and Kayla, and they reiterated. Mr. Holt had come to my home on Feb. 21, telling me, "I left my house @ 5:15, ran west down Red Oak, turned left towards the AMA Hall, and as I cleared the house on the corner, I noticed flashing lights, spotlights, and two police cars in the park. I continued my jog, and as I neared the swingset, I thought it was my son, Justin, hanging there. I took off running towards my home, ran up the stairs, woke Justin, explained to him what I had just seen, and why he called your house, I don't know." Per our phone conversation, he told me did return to the 'scene of the crime', asking why he wasn't stopped as he ran, and he was told, 'because we knew who you were, Mr. Holt.'
Justin, Michael's friend, called our house @ 6:29AM, telling Michael that someone was hanging in the park. Michael came to me, telling me he needed to tell me something and to sit down. I was sitting down, but when I looked in to his eyes, I KNEW this was SERIOUS! He told me that someone was hanging in the park, and without thinking, I asked him to run down there (one block away), see what's going on and come right back. He didn't.
I called Det. Martin back, telling him he hadn't talked to anyone but Michael. He told me found out all he needed to know from him. I told him, "NO, I was the last person to see Joshua (or so I thought), had you talked to me, you may have gotten a different persspective!"
I found out in March, that a McGregor patrol officer was the last person to see Josh alive in Amsler Park @ 1AM. Per the unknown officer's statement, 'Joshua was not yet hanging in the chain.'
My questions went unanswered, and McGregor got a new chief, Ron Wadkins, on May 1, 2006. In June, 2006, four of the five officers, on scene, resigned simutaneously, for unknown reasons.
Finally, in January, 2008, Wadkins answered Question #1: "It's not like the officers have drivers license numbers in their heads. A wants and warrants check is done in case there's a warrant, it can be dismissed." I replied, "Who cares, he's dead!"
I contacted the Texas Rangers, specifically Steve Foster, to request an investigation into my son's suspicious death. He/They denied me several times over the course of about 2 years...........NOW, Foster is Chief of Police/McGregor! Coincidence?
I contacted the FBI, because if my belief that McGregor PD murdered my son, this was a blatant violation of Josh's civil rights. I even contacted sen. John Whitmire, explaining to him what Agent Truitt/FBI had said to me. As I was on the phone with Whitmire, he called Agent Truitt, and Truitt told him that Joshua was not important enough to open an investigation on!!!!!!!
